"The Bombay High Court in a recent case dealt with the issue of domain names – in particular those that have a suffix or a prefix that is a generic word used worldwide. An International Law Office report says it is unclear how the domain name should be treated in these cases – as a whole, or by splitting it in order to give it trademark protection. The dispute arose with regard to the use of the word '2win' by the parties. The plaintiff, which created and promoted online games and contests, sought interim relief for passing off. It contended that the defendant has been using the word 'bid2win' and that word was deceptively similar to its own mark CONTEST2WIN, which it had created for use in respect of online games..."
